Pharmacists may be allowed to deny birth control pills to rape victims in Texas

A while ago, this woman got raped and so showed up at a pharmacy (with a prescription, from what I've heard) requesting a morning after pill. The pharmacist refused to fill the prescription because (s)he objected to the concept of birth control. People got pissed at Eckerd, the pharmacy, which is a bit unfair as Eckerd has clearly stated that that pharmacist wasn't acting in accordance with the store policy, and that the pharmacist has since been disciplined. In the end, the woman got her pill filled out at another pharmacy, and so everyone lived happily ever after, right?

Texas is trying to pass a bill that will prevent a pharmacy from disciplining a pharmacists who refuses to fufill an emergency birth control pill. Exact wording follows:

Sec. 103.003. DISCRIMINATION PROHIBITED. (a) A hospital, health care facility, or pharmacy may not discriminate against a physician, pharmacist, nurse, staff member, or employee, or an applicant for one of those positions, who refuses to: (1) perform or participate in an abortion procedure; or (2) dispense or participate in the dispensing of an emergency contraceptive.

I'm against this simply by analysis of utility. How much does it hurt the pharmacist do go against his belief and just give out the birth control pills? How much does it hurt the rape victim to respect the pharmacist's beliefs and raise the illegitimate child? I think the action that minimizes harm (and thus maximizes world happiness) is for the pharmacists to be forced to hand out any medication for which a person has a prescription regardless of their beliefs.

The argument that's frequently brought up is "If you're not willing to dispence medicine, don't become a pharmacist" which I think is a very good argument. The reversal of that argument, "If you're not willing to raise a child, don't be a rape victim", ... not so good.

Now, of course, I know the other side is saying, yes, but this is a moral issue. Yeah, but the problem is, not everyone gets their morals from the same book. You go by the book that says slavery is okay but sex is wrong until after marriage, at which point it becomes a blessed sacrament between a husband and the wife who is withholding it.

In conclusion, let me say to all the activist pharmacists out there, the ones who think sex is bad probably because sex with them always is. Fellas, a pharmacist is not a law-giver, not even a doctor. In the medical pecking order, you rank somewhere in between a chiropractor and a tree surgeon.

You don't answer to a law above the laws of men. You work for Sav-On. The doctors are the ones who make medical decisions because they went to medical school, whereas you were transferred from the counter where people drop off film.»
